Nearly every time I go to rent a car at an airport, the salesperson at the kiosk spends at least 10 minutes telling me about my absolute need for car insurance. What she doesn’t know is that my job is to work through insurance mishaps every single day. So… Here’s what goes through my head when the salesperson drones on and on about the 20 dollar a day add-on.

Me: I really am not interested.

Them: It’s only 20 dollars a day and it could save you from needing to repair the car if someone from the Bronx sideswipes you. Are you sure you don’t want it?

Me: No thanks

Me to myself: I already am covered two different ways. My car insurance policy covers when I drive a rental. It was one of those “add-ons” I found out about after I got my first insurance policy statement. Of course I didn’t ask for it, but it’s only a couple of bucks anyway. Also… the credit card I just gave this salesperson to pay for the car automatically gives me insurance on cars I rent with it. It’s actually something that is added onto ALL of my credit cards. I really feel sorry for folks who fall for this. Anyway… I’m running late.

Me: I don’t mean to be rude, but please give me the keys. I’m late for an appointment with a potential client who was just side-swiped in an accident in the Bronx while visiting family.

Following are the most common types of accidents encountered on the roadways. Although not comprehensive, they represent the vast majority of accident types.

 Rear end collisions

Head on collisions

Rollover accidents

Side impact collisions

Truck underride accidents

Backup accidents

The range of injuries are much more varied. People commonly experience back and neck injuries in automobile accidents, but injuries could be as severe as limb amputation, brain damage or death. For example, we recently received an inquiry from an individual involved in a semi-truck accident. He was in the process of having his car towed after a breakdown. The tractor trailer came up at excessive speed, hit the tow truck and dragged the driver and tow truck several hundred yards from the initial collision. The tow truck operator was declared dead immediately and the semi driver incurred minimal whiplash injuries. I use this example to illustrate the many factors that have to be looked into when evaluating a case. There were multiple insurance contracts to review, company liability issues to examine and three parties that sustained different injuries all involved in one crash. We deal with these types of cases all the time. If you have been involved in a crash, let us know and we’ll give you a preliminary review of your rights free of charge.

One of the most dangerous types of accident is the accident involving an automobile and a semi truck. It is alarming that so many accidents are caused by these professional drivers. One would think that truck drivers would use a heightened awareness of potential risks to help reduce accidents on the highways. Unfortunately this is not always the case. In a big rig accident, there is almost always a serious injury and frequently death. If you think that your insurance premiums are high, this ought to bring the dangerous nature of truck driving into perspective. An average individual is usually required to maintain $15 thousand in liability insurance on their vehicle. By contrast, most truck companies are required to carry at LEAST $600 thousand dollars to cover the potential damages their trucks will incur in a crash. It is even considered customary for a trucker to carry over one million dollars in order to carry interstate loads.

Under the law, any individual is allowed a certain amount of time to bring a lawsuit to court. This is evident in both criminal and tort law. Just as the government cannot charge you with a crime after a predetermined time limit, another individual or insurance company must act in a timely manner to bring a lawsuit against you in a civil case. Although this time period varies from state to state, a general rule is that you must bring a lawsuit within 2 years of the accident or forever hold your peace. You can identify your state’s statute of limitations by going to your state bar’s website. If you don’t know where to find that information and would like us to help determine your state’s statute of limitations, send an e-mail and we’ll try to help you figure it out. If you were injured in an accident less than two years ago, in all likelihood you should still be able to sue for damages as long as you have a decent history of medical care and have not already tried to sue. The Car Accident Claim Center deals with issues of statues every single day and can provide reviews for you at no charge.

When someone hits another from behind, he or she is nearly always at fault in a car accident. Although it seems that a hit from behind might result in a less severe injury, in actuality most car related injuries are caused by this type of accident. Whiplash is a common injury from a rear end collision and is not always noticed at the scene of an accident. Often the extent of these injuries do not show up until well after the initial crash and are only fully realized after many physical therapy sessions. If you have been hit by another driver from behind, it is very important to make sure you have legal representation as soon as possible because the medical bills associated with whiplash can often add up to thousands of dollars in a very short period of time.
